MESSAGE FROM THE CENTER DIRECTOR
Federal Service Labor-Management Relations Statute
This message is being sent in settlement of the unfair labor practice charge filed by the Ames Federal Employees Union, IFPTE Local 30 (Union) against NASA Ames Research Center (Agency) with the Federal Labor Relations Authority, alleging that representatives of the Agency engaged in conduct which interfered with the Union's exercise of its rights under the Federal Service Labor Management Relations Statute (Statute).
In recognition of our obligations under the Statute, this is a reminder to all supervisors and management officials that management will not threaten or interfere with any individual engaged in an activity protected by the Statute. Management will not make statements to Union officers or bargaining unit employees that threaten or coerce them in the exercise of protected activity and will not in any like or related manner, interfere with, restrain, or coerce our employees in the exercise of their rights guaranteed under the Statute.
Further, the collective bargaining agreement between the Agency and the Union specifically provides that:
"Employees may exercise the rights and provisions of this Agreement without intimidation, threat or coercion. For purposes of this Agreement, the term 'intimidation, threat, or coercion' includes, but is not limited to promising to confer or conferring any benefit (such as appointment, promotion, compensation, settlement, or redress), or effecting or threatening to effect any reprisal (such as deprivation of appointment, promotion, or compensation)."
